When you and your spouse have an agreement on how to leave peacefully, the agreement in writing.
Some couples create what we call ‘an agreement incident to divorce’. If the court finds this agreement unjust, the judge may order you to create another agreement.
This rule applies to child custody issues too.
You do not want a mere contract; you need a court order. Once the court approves your agreement or incorporates it into a signed decree/order, then it is enforceable. Its enforceability, however, depends on how specific the language of your agreement is.
If the thought of going to court scares you, you can resolve your legal issues outside of court. At the very least, ask an attorney to review the agreement before you sign it.
In moments of desperation, people say yes and sign their names to unconscionable contracts. For example, a husband may agree to indefinite alimony (spousal maintenance); other times, a wife, not knowing what she is entitled to, agrees to no child support.
