Mediation is an alternative dispute resolution, another form of resolving conflicts. It is not unusual for emotions to be high and families become tense during a divorce. Custody issues also tend to generate high emotions. Most cases in Harris county, Texas are ordered to mediation. The judges want the parties to try to resolve issues and reach a compromise on one, if not all parts of the suit. In a mediation, a neutral person serve as a facilitator (i.e. referee).

 

 

 

In a divorce dispute where a couple has a child, child custody and child support are heavily discussed and must be  properly advocated. Judges try to divide assets equally between the spouses and prefer joint managing conservatorship. However, there are cases where one spouse asks and receives a higher share of the properties than the other spouse. For example, where one party is a victim of cruelty from the other spouse, the abused spouse may receive a higher share of the property.

 

   

CHILD CUSTODY & ENFORCEMENT

If you have been held in contempt of not following court order, you need legal assistance. Contempt is a serious legal matter that can carry civil penalty such as a fine             and/or a criminal fine. Criminal penalties according to the Texas Family Code carry up to 6 months in a local jail; this usually occurs where the non-custodial parent               has failed to pay child support and owes in arrears.

Court Appearances: in limited circumstances and upon review of your case, we appear as your attorney to argue your case. However, this option does not apply to complex or contested divorces due to the preliminary work and preparation that are necessary for a successful litigation.
