First, separation is not the same as divorce.
A divorce is a legal dissolution of a marriage. Therefore, in order to get a divorce, you must ask the court for it. There are several steps to note when filing for divorce.
When you file for a divorce in Texas, the court wants to know: the parties, are children involved, and property division. Who will get to decide where the child will live? Is there any agreement between the spouses? Who will cover the children’s health insurance? If there are no kids involved, is there real property? Are there personal properties that the parties need to split?
How long will my divorce take?
In Texas, there is a cooling period of 60 days. You start counting from the date your divorce suit is filed. The timeline for your divorce depends on whether it is contested or uncontested. Uncontested divorces are agreement between the spouses. Contested divorces tend to take a long time because of the disagreement between the parties on who should get what.
